This website is operated by SGHT Co. (“SGHT,” “we,” “our,” or “us”). These Terms of Use explain the rules that apply when you visit or use www.sght.co (the “Site”).
By accessing or using the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site.
Relationship to the Visibility Services Agreement
The Site is for general information and communication only.
All SGHT services—including any ongoing visibility work, add-ons, or projects—are governed by the SGHT Visibility Services Agreement (VSA) and any signed add-on scopes or statements of work.
If there is any conflict between this page and the VSA, the VSA controls for all paid services.
Use of the Site
You agree to use the Site only for lawful purposes and in a way that does not interfere with or damage the Site or other users.
You agree not to:
Attempt to gain unauthorized access to the Site or its systems
Use the Site to send spam or other unwanted communications
Upload or transmit content that is unlawful, defamatory, abusive, or infringes on the rights of others
The Site is not intended for creating an attorney–client, agency–client, or other professional relationship by itself. That relationship is formed only when we both sign the appropriate agreement (for example, the VSA).
Content and intellectual property
Unless stated otherwise, the Site and its contents—including text, graphics, logos, layouts, and other materials—are owned or licensed by SGHT and are protected by applicable intellectual property laws.
You may view the Site for your own business use, but you may not copy, reproduce, modify, or distribute any content from the Site without our written permission, except as allowed by law (for example, brief quoting with attribution)

Payments and billing

Actual fees, billing terms, and scope of work are defined in the Visibility Services Agreement (VSA) and any signed add-on scopes. Those written agreements govern payment obligations and will control over any conflicting information on the Site.
No guarantees/disclaimer
The Site and its content are provided on an “as is” and “as available” basis. While we aim to keep information accurate and current, we do not promise that the Site will always be error-free or that any particular result will follow from using our services.
Any examples, descriptions, or references to past engagements are illustrative only and are not promises or guarantees of future results.
Limitation of liability
To the maximum extent permitted by law, SGHT and its owners, employees, and contractors will not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Site or reliance on its content.
Nothing in these Terms of Use limits liability where such limitation is not allowed by law.
Indemnification
You agree to indemnify and hold harmless SGHT from any claims, losses, or damages arising out of your misuse of the Site, your violation of these Terms of Use, or your violation of any rights of a third party.
Governing law
These Terms of Use are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
Any dispute, claim, or controversy arising out of or relating to these Terms of Use or your use of the Site will be resolved exclusively by binding arbitration. The arbitration will be conducted in Collin County, Texas, by a single arbitrator under the then-current Commercial Arbitration Rules of the American Arbitration Association (AAA) or a similar recognized arbitration body, unless we mutually agree otherwise in writing.
You and SGHT agree that:
Each may bring claims only in an individual capacity, not as a class member or representative.
The arbitrator may award individual relief but will not have authority to conduct class or representative proceedings.
Either party may seek temporary or preliminary injunctive relief in a court located in Collin County, Texas, to protect its rights while arbitration is pending.
By using the Site, you waive the right to a trial in court (including a jury trial) and agree that arbitration is the sole method of resolving disputes covered by this section.
Changes to terms
We may update these Terms of Use from time to time. When we do, we will change the “Last updated” date at the top of this page. Continued use of the Site after changes are posted means you accept the revised terms.
